We are not the Homeowners Association (HOA) or Property Owners Association (POA) for The Point, and we do not act for, speak for, or represent any association, board, committee, architectural review body, club, developer, or governing entity.

Nothing on this Site is an official communication, rule, covenant, bylaw, assessment notice, approval, or determination of any association or club. Governing documents, dues, amenity access, architectural approvals, membership eligibility, and enforcement are controlled exclusively by the applicable association, club, or governing body. Always obtain official documents directly from those entities and confirm all requirements in writing before relying on anything you read here.

Content on the Site is provided for general informational and illustrative purposes only. It is not legal, tax, financial, investment, insurance, engineering, appraisal, surveying, construction, or real estate advice, and it is not a substitute for independent professional counsel or your own due diligence.

You agree to defend, indemnify, and hold harmless the Operator and its owners, officers, members, employees, agents, affiliates, and licensors from and against any claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or your reliance on any content.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Iredell County or Mecklenburg County, North Carolina, and you consent to personal jurisdiction there.

The parties will first attempt to resolve any dispute informally for thirty (30) days after written notice. Any claim must be brought within one (1) year after it arises or it is permanently barred. Claims must be brought individually; class actions, collective actions, and representative proceedings are waived to the fullest extent permitted by law.

If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site. Headings are for convenience only.
